NEW YORK (AP) — The family of a Canadian man struck and killed by a truck while riding his bike in Brooklyn has sued the NYPD to release the accident records.

The lawsuit was filed in Manhattan by the parents of Mathieu Lefevre. It claims the police improperly denied their request for records under the state’s Freedom of Information Law.

According to the lawsuit, the NYPD said it could not release the evidence because the investigation was continuing.

According to The New York Times, the family’s lawyer, Steve Vaccaro, said in the complaint that the FIO law permits police to withhold only information that would interfere with the investigation.

The police have said no criminal charges would be filed, therefore, Vaccaro said the release of the records could not prejudice any prosecution.
