Judge Montalbano discusses domestic violence cases at Columbian Lawyers event

The Columbian Lawyers Association of Brooklyn held its monthly meeting at the Rex Manor in Dyker Heights on Tuesday during which Judge Rosemarie Montalbano presented a continuing legal education seminar on domestic violence.

Montalbano, who sits in the Kings County Criminal Court, explained that domestic violence is often hidden from view and devastating for families because it can affect them physically, emotionally, spiritually and financially. The impact is often especially harsh on the children, who learn that it can be an acceptable way to cope with stress or problems, the judge said.

The judge discussed the various types of domestic violence, including physical, sexual, emotional, economic and psychological abuse.

Domestic violence will affect one in four women in their lifetime and 15.5 million children live in families where domestic violence has been perpetrated within the last year, according to statistics provided by the Office of Court Administration.

In 1994, the Family Protection and Domestic Violence Act created a mandatory arrest policy for NYPD if they have probable cause that a crime was committed even if the victim refuses to press charges.

Brooklyn is home of the first-ever domestic violence court, which was created in 1996. The model has been copied all over the state. The domestic violence court dedicates a judge for each case with a staff trained specifically to handle those types of cases. The courts help victim safety and greater access to support services.

The Columbian Lawyers Association will be in Connecticut this weekend as it hosts its annual continuing legal education weekend seminar on Friday and Saturday. Speakers will include Hon. Ellen Spodek, Hon. Anthony Cannataro, Hon. Laura Genovesi, Hon. Marsha Steinhardt, Rachel Gold, Deborah Scalise and Sharon Stiller.
