SKETCHES OF COURT: Absent defendant faulted for traffic accident

The September 2012 motor vehicle collision occurred in opposing traffic on Park Avenue in Brooklyn, when Johnstan Joseph’s car was struck by a vehicle making a left turn onto Taaffe Place. Binder recounted a litany of injuries that his client claims to have sustained as a result of the impact. 

Defendant driver David Katz was represented by Claude Laroche (at right), of the law offices of James G. Bilello & Associates. Laroche alleged that Joseph shared fault for the accident, maintaining that Joseph had the last chance to have avoided the impact and had failed to see what should have been seen.

Joseph sustained a left knee medial meniscus tear for which he underwent surgery and several months of physical therapy. Joseph’s injuries also included herniations in his neck and back. Laroche cited medical reports that indicated Joseph’s range of motion was within normal limits, to which Binder countered that Joseph nevertheless presently remains in constant pain.

Laroche’s client failed to appear in court. The jury returned a plaintiff’s verdict, determining that Katz was wholly responsible for the accident. Joseph was awarded a total of $150,000 as compensation for past and future pain and suffering in the trial that resolved last week in Kings County Civil term.
