SKETCHES OF COURT: Two-car collision on zebra-striped roadway

In this courtroom sketch, Hon. Lawrence Martin listens during the testimony in the motor vehicle trial of Adham Hossam Gaber v. William Quan that took place last week in Kings County Civil Term. The plaintiff, under direct examination by attorney Gil Zohar (standing) of the Brooklyn law offices of Alexander Bespechny, Esq., is pointing to a photograph of the roadway where a 2-car collision took place in July 2010. The plaintiff’s attorney is seeking to establish the position of the vehicles relative to the zebra-striped safety zone seen in the photograph, at the intersection of Hamilton Ave. and Bowne St., by Richards St. behind the Brooklyn entrance to the Battery Tunnel.

The front of the plaintiff’s vehicle, which was travelling from the direction of Bowne St., struck the passenger doors of the defendant’s vehicle at a point between Hamilton Ave. and Richards St. The defendant is represented by attorney Howard J. Kaplan (seated, right) of the law firm Adams, Hanson, Rego, Carlin, Kaplan & Fishbein. 

The jury in the bifurcated trial determined that both parties were negligent, finding the defendant 70 percent and the plaintiff 30 percent at fault. The injuries were not discussed during the liability phase of the trial, but both vehicles sustained damage and the defendant suffered a torn left shoulder. Both parties have consented to a high-low contract as the damages phase of the trial continues this week.
