Penny manslaughter charge dropped after second jury deadlock
MANHATTAN – THE PROSECUTION IN the trial of Daniel Penny for the death of Jordan Neely moved on Friday to dismiss the manslaughter charge against Penny, after the jury twice told the court that it was unable to come to a unanimous consensus on that count, reports CNN. Penny was charged with second-degree manslaughter and criminally negligent homicide, but the jury was not allowed to discuss the lesser negligence charge until after it finished deliberation on the greater manslaughter charge. Penny’s defense team moved for a mistrial after the first deadlock and maintained the motion after the second. Judge Maxwell Wiley granted the prosecution’s request and dropped the manslaughter charge, instructing the jury to proceed with the negligence charge, and declined to call a mistrial. The jury will return on Monday for further discussion.
