Red Hook condo board sues developer at New York Dock Building

RED HOOK — THE CONDO BOARD AT Red Hook Lofts, formerly known as the New York Dock Building at 160 Imlay Street, filed a lawsuit last month that claims unsafe and poor-quality repairs were conducted at the 70-unit building, reports Habitat Mag. The condo board alleges that developer Est4te Four Capital and other associated entities have committed fraud, breach of contract and unjust enrichment.

Residents are seeking $60 million in compensatory and punitive damages. The suit claims that the building was in terrible condition upon move-in, with cracks, holes, leaks, failing parapets, a dangerously unusable roof deck, toilets falling off of walls, and poorly designed HVAC and soundproofing, among other issues. It also alleges that members of an earlier condo board installed by the defendants improperly used money intended for general maintenance to perform work that was promised during the sales period – a cost that should have been shouldered by the defendants, according to the suit. The residents cite another lawsuit that the defendants are involved in, between the developer and the building’s general contractor, as evidence, saying that the defendants admitted in that suit that the building was incomplete. No one involved responded to a request for comment from Habitat.

The Department of Buildings earlier required the erection of a protective sidewalk shed to shield passersby from the falling rooftop debris. According to the suit, the building does not yet have a certificate of occupancy, and neither the DOB nor the FDNY has signed off on its fire safety system.
