Brooklyn father and son indicted for misusing PPP funds on real estate and luxury car purchases
District Attorney Eric Gonzalez, along with federal authorities, announced that two Brooklyn contractors, a father and son, have been indicted for allegedly defrauding more than $1 million from the Paycheck Protection Program (PPP) during the COVID-19 pandemic.
The defendants, Nurus Safa, 65, and Maidul Safa, 34, are accused of submitting fraudulent tax returns to inflate their construction company’s revenue and using the PPP funds for personal purchases, including two homes in New Jersey and a luxury BMW sedan.
“These defendants allegedly engaged in a shameless scheme to steal more than $1 million from the Paycheck Protection Program and line their own pockets with critical funds intended to help struggling small business owners during the COVID-19 pandemic,” Gonzalez said. “We will now seek to hold them accountable. I want to thank the Small Business Association for its assistance in pursuing justice in this case.”
The indictment, filed in Brooklyn Supreme Court, charges the defendants with first- and second-degree grand larceny, criminal possession of a forged instrument, and falsifying business records.
According to the investigation, Nurus Safa, owner of Rahil Contracting Inc., and his son, Maidul, a project executive, applied for and obtained two PPP loans totaling more than $1 million. Despite certifying that the funds would be used for payroll and business expenses, the defendants allegedly used the money to buy two five-bedroom homes and put $71,000 down on a 2021 BMW M5 sports sedan.
Prosecutors said an analysis of financial records revealed no evidence that the funds were used for employee wages, with much of the money transferred to personal accounts held by the Safas.
The defendants were arraigned and released without bail, with a court date set for Oct. 30.
