SKETCHES OF COURT: Jury finds both defendants at fault in traffic accident

In this courtroom sketch, Hon. Blash represented two of the plaintiffs, while Raymond Carroll (seated at left) represented a third. Carroll is trial counsel to the law offices of Davis, Saperstein & Salomon. At issue in the bifurcated trial was the determination of liability.  

The plaintiffs are three coworkers who boarded a livery cab in Williamsburg and traveled southbound on Wyeth Avenue in October 2013. They reached North 10th Street, where they collided with a passenger car traveling westbound. Emergency personnel summoned to the scene found the cab wrapped around a pole, airbags deployed. The plaintiffs claim that they sustained serious injuries due to the impact and are suing both drivers.

Angela Capri (at right), of the law offices of James G. Bilello & Associates, represented the passenger car driver. Her client testified that after obeying the stop sign governing the intersection, she could not see clearly down the block and slowly inched forward. Capri alleged that the cab was speeding when the collision occurred and was wholly responsible for the accident.

Robert Giovinazzi (seated second from right), of the law offices of Nancy L. Isserlis, represented the livery car driver. He maintained that his client was not responsible for the accident and denied the accusation of speeding, though his client offered conflicting testimony as to whether he did or did not see the passenger car before the impact. 

The jury found that both defendants were negligent, attributing 35 percent fault to the cab driver and 65 percent fault to the passenger car driver. The parties agreed to a settlement before the trial proceeded to the damages phase in Kings County Civil Term. Court reporter Jacqueline Miles recorded the proceedings.
