A man who was granted a new trial in the 1988 killing of two friends will be freed from prison.

The New York Times reports state Supreme Court Justice Desmond Green ordered Shabaka Shakur released from prison Thursday afternoon. The order came after prosecutors moved to dismiss the indictment against the 50-year-old.

Shakur will likely be released Friday after 27 years in prison.

Green ruled earlier this week that there was a “reasonable probability” Shakur’s confession was fabricated and granted him a retrial. Brooklyn District Attorney Kenneth Thompson decided Wednesday that he wouldn’t retry Shakur.

The case is one of many involving retired detective Louis Scarcella that have come under scrutiny. Scarcella has denied any wrongdoing.

The district attorney has moved to have several cases thrown out.
