SKETCHES OF COURT: Brooklyn Hospital Center’s malpractice trial
In this courtroom sketch, Hon. Bert Bunyan listens as attorney Bruin Hays (standing) of the New York law firm Dopf, PC conducts a direct examination of an expert witness in the medical malpractice trial of Robert Geltzer v. Ibis Yarde, MD, and the Brooklyn Hospital Center. Hays was retained to represent the interests of the Hospital, where Dr. Yarde is an emergency room physician at the hospital. On the stand, Dr. Joseph LaMantia, an emergency room physician at the North Shore University Hospital in Manhasset, testifies as an expert witness for the defendant. Representing Dr. Yarde is attorney Barry Schreiber (seated, right), of the New York law firm Aaronson Rappaport Feinstein & Deutsch, LLP.
In August of 2009, Marvin Johnson suffered respiratory arrest and collapsed while at a drug store in Brooklyn. He was taken to Brooklyn Hospital Center, where the emergency staff was unable to revive the patient. Mr. Johnson never regained consciousness.
Richard L. Goldberg (seated, left), of the Brooklyn law firm Peters, Berger, Koshel & Goldberg, represents the administrator of the estate for the patient’s mother. The plaintiff’s attorney alleges Dr. Yarde was negligent in the patient’s care resulting in his wrongful death, as she was unable to resuscitate or intubate the patient. The defense noted the patient’s co-morbidities including obesity. They denied negligence and alleged that the doctor followed reasonable medical care.
The trial took place in last week in Kings County Civil Term. Mr. Marvin was unemployed and childless. The parties have since agreed to a consummation of settlement.
