LICH hearing postponed; no movement in Appellate Division

The contentious battle between the employees of Long Island College Hospital and State of University of New York (SUNY) Downstate Medical Center lags on in Brooklyn courts.

A temporary restraining order issued by Brooklyn Supreme Court Justice Johnny Lee Baynes, preventing SUNY Downstate from taking measures to close LICH, scheduled a hearing for July 15 at 2:30 p.m.  It has been reported that Baynes also issued an order assigning a referee to investigate and report to the court on whether or not the temporary restraining order is being adhered to and to recommend solutions for resolving the case.

Attorneys for SUNY filed papers on June 28 in the Appellate Division, Second Department, a higher court, requesting a stay on the referee order. A hearing on this stay request has not yet been scheduled.

In light of the stay request pending in the Appellate Division, Baynes has postponed the July 15 hearing, presumably until the issues in the higher court are first resolved.
