Change in Child Support and Maintenance Caps

This week Hon. Jeffery Sunshine, the Kings County Supreme Court Supervising Judge for Matrimonial Matters, sent an email to local bar association leaders regarding a change to child-support and maintenance monetary caps that went into effect Jan. 31.

“In accordance with provisions of DRL 240 and FCA 413 (through the mechanism enunciated in Social Service law 111(1)(2)(b)), the cap has increased for child support to $136,000 and temporary maintenance to $524,000. This increase is reflective of the increase in the CPI. In accordance with the statute, the cap changes every two years,” Sunshine explained in his email.
