Brooklyn Man Sues Apple Over Siri Disappointment
A Brooklyn man’s Apple-powered personal electronic assistant has given him buyer’s remorse and he’s suing over it.
Frank M. Fazio has brought a class action law suit against Apple for allegedly misleading him into buying an iPhone 4S by “misrepresenting” the functionality and value of the phone’s exclusive Siri feature, as first reported by the Wall Street Journal’s Law Blog.
Siri is a “voice-activated assistant” and according to Apple’s frequent TV spots, the software is useful for quickly retrieving all sorts of information at the simple prompt of a spoken request. But according to Fazio, Siri is not what her promoters would have us believe.
The complaint that the San Francisco Law Firm Robbins Geller Rudman & Dowd has filed on Fazio’s behalf recounts his dawning dissatisfaction with Siri: “Promptly after the purchase of his iPhone 4S, Plaintiff realized that Siri was not performing as advertised. For instance, when Plaintiff asked Siri for directions to a certain place or to locate a store, Siri either did not understand what Plaintiff was asking, or, after a very long wait time, responded with the wrong answer.”
According to the filing, Fazio would never have bought the iPhone 4S if he hadn’t believed in Siri’s “touted benefits,” and for this reason, it requests “an award of compensatory damages, statutory damages, restitution, and all other forms of monetary and non-monetary relief recoverable under California law.”
